Michael Jordan Tells Court He Felt No Fear of Nascar in Antitrust Trial
Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, admitted that his drive to win and status as a newcomer emboldened his effort with 23XI Racing to confront Nascar over perceived violations of antitrust rules.
Financial Stakes and a Competitive Drive
Jordan shared financial and corporate details of his 23XI team, revealing he put in $40m of his own funds into the Nascar Cup series team co-founded with partner Polk and driver Hamlin.
“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I believed I could take on Nascar as a whole. From my perspective, the sport required examination through a new lens.”
The Core Dispute: Franchise System and Renewal Demands
At issue is the end of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other professional sports with separately owned franchises, such as the NBA’s Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar demanded teams renew their charters.
Jordan testified for about sixty minutes and left the court to a media frenzy, with onlookers and reporters clamoring for a view or a picture of the global icon.
Leading the Legal Charge
23XI Racing is at the forefront of the push along with another racing team for Nascar to change a operating model Jordan contended is breaking the law to maintain excessive control.
For Jordan and and a fellow team representative, who preceded Jordan, are events from September 2024. She recounted a hectic and tense six hours where the sanctioning body told teams they had to sign a contract extension. This agreement consists of over a hundred pages detailing team compensation and a guaranteed entry in Nascar-sponsored races.
A Refusal to Sign
Jordan said that his team and its ally decided their sole viable path was to refuse a signature that 112-page package and litigate the matter. All other teams signed the agreement.
Jordan and co-owner Denny Hamlin reached out to Nascar about potential amendments or extension options. Nascar refused to engage, according to his testimony.
The Bottom Line: Winning
But in the end, the pushback against what he saw as a financially unsustainable model was mostly about the familiar goal for Jordan: Success.
“Hamlin persuaded me adding a third car improved our chances to win,” he testified, sharing that he purchased another franchise last year for $28 million despite the uncertainty. “So I took the plunge.”
Account from the Gibbs Family
Heather Gibbs detailed her push for indefinite franchises, submitted in a written letter to Nascar. She testified the pressure of the contract signing demand was problematic.
She said, Joe Gibbs first attempted to call and persuade Nascar against forcing signatures, but Nascar’s leader declined the request.
“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s leadership. The response was, “If I wake up and I have 20 charters, that’s what I have. If I have 30, that’s the number.”
